Upwork’s messaging, Zoom, and call systems (for contracted clients)
Dribbble’s messaging system (for Dribbble-initiated clients)
To ensure accountability and transparency, we recommend using platform-specific communication methods after project initiation.
3- Payments & Project Management via Upwork/Dribbble
We proudly use Upwork’s Direct Contract feature through our Upwork Agency Profile and Dribbble's project initiation platform to manage all project payments and milestones. This ensures:
Escrow-backed security
Transparent project timelines
Structured communication & file sharing
Neutral dispute resolution mechanisms
We’ve chosen both Upwork and Dribbble for their strong compliance frameworks, industry-standard protection, and peace of mind for both our agency and clients. Funds are released only when you’re satisfied with delivered work.
By agreeing to work with us, you consent to using either Upwork or Dribbble platforms (depending on the point of contact) for payment processing and project oversight, unless otherwise agreed in writing.
Projects initiated through Dribbble will be managed exclusively using Dribbble’s platform — including messaging, milestone payments, and delivery of final work. All project interactions, revisions, and deliverables will be handled within Dribbble to ensure consistency and compliance with their platform’s policies.
4- Client Responsibilities
Clients are expected to:
Provide all necessary project materials and instructions in a timely manner
Respond to feedback requests within agreed timelines
Fund milestones before work begins (within Upwork or Dribbble)
Neutral dispute resolution mechanisms
Delays in communication or payment may affect the project timeline.
5- Intellectual Property
All rights to final deliverables are transferred to the client upon full payment. DSpot Creative reserves the right to display non-confidential work in our portfolio unless a Non-Disclosure Agreement (NDA) is signed. To request a Non-Disclosure Agreement, mention in writing during conversation to our consultant through relevant platform Upwork/Dribbble or email us at: hello@dspotcreative.com.
6- Refunds & Cancellations
Refunds are subject to the terms agreed upon within the Upwork or Dribbble contract.
Before project start: Full refund (minus processing fees)
After project initiation: Refunds will reflect completed work to date
All refund disputes are handled via the respective platform’s resolution process.
7- Limitation of Liability
We are not liable for indirect damages, lost profits, or issues resulting from third-party service providers or platforms (e.g., hosting providers, app stores, ad platforms). We are also not responsible for project delays caused by insufficient client input or third-party interruptions.
8- Confidentiality
All client data, brand assets, and internal communications are treated as confidential. We do not share or sell client information under any circumstance.
9- Changes to Terms
We may update these Terms of Service occasionally. Any significant changes will be reflected on this page with an updated effective date.
